In short
- We collect only what you send us, and the technical data needed to run the website.
- We use no analytics tools at all: no Google Analytics, no trackers, no advertising cookies. That is why there is no cookie banner.
- We never sell your personal data.
- You can ask to see, correct or delete your data at any time, free of charge.
1. Who we are
This policy explains how Innovation Mode Limited, a private company limited by shares registered in Ireland (company number 785034), with its registered office at 51 Bracken Road, Dublin 18, D18 CV48, Ireland ("Innovation Mode", "we", "us") collects and uses personal data through theinnovationmode.com (the "website"). We are the data controller for that data.
We are established in Ireland, so the EU General Data Protection Regulation (GDPR) and the Data Protection Acts 1988 to 2018 apply to what we do, and the Data Protection Commission is our supervisory authority.
For any privacy question or request, email info@theinnovationmode.com. We have not appointed a data protection officer, as the law does not require one for our activities.
2. What this policy covers
This policy covers the website, its contact and membership forms, the newsletter, purchases of our digital products, and the emails we exchange with you.
It does not cover Ainna.ai, which has its own privacy policy, or other websites we link to, such as publishers, booksellers, LinkedIn and YouTube. Advisory engagements are covered by the agreement we sign with your organisation.
3. The data we collect and why
We collect personal data only in the situations below. For each one, we explain what we collect, why, the legal basis under the GDPR, and how long we keep it.
When you visit the website
- What: your IP address, browser and device type, the pages you request, the referring page, and the date and time of each request.
- Why: to deliver pages, keep the website secure, prevent abuse of the forms and diagnose faults, and to count visits and page views in aggregate statistics that identify no one. These statistics use no cookies.
- Legal basis: our legitimate interests in running a secure website and understanding how it is used (Article 6(1)(f) GDPR).
- How long: no longer than 30 days, unless we need the logs to investigate a security incident.
We use no analytics service. No Google Analytics, no tag managers, no tracking pixels, no third-party analytics of any kind. Visits are counted from our own server logs, in aggregate, and nothing about your visit is shared with an analytics provider.
When you contact us
- What: your name, email address and message, and, where a form asks for them, your organisation, role, type of request, timing, and the size of your organisation, class or audience. The same applies when you email us directly.
- Why: to reply, prepare a proposal, arrange an interview or talk, or give academic access to our materials.
- Legal basis: steps you ask us to take before entering into a contract (Article 6(1)(b) GDPR) when you request a proposal or a licence, and otherwise our legitimate interests in answering the people who write to us (Article 6(1)(f) GDPR).
- How long: as long as we need to deal with your request and any follow-up, and no longer than two years after our last contact, unless it leads to a contract.
When you become a member
- What: when you join with LinkedIn, LinkedIn tells us your name, your email address and your language, and gives us an identifier for you that only our website uses. It also sends a link to your profile photo, which we do not keep. We do not receive your LinkedIn profile, your contacts or your activity, and we never post anything for you. We also record when you joined and signed in, which free downloads you open, and the words beside the Join button when you joined. If you joined before membership moved to LinkedIn, we hold your email address and, if you gave it, your first name.
- Why: to run your membership: to send you The Innovation Mode Newsletter (about one email a month) and occasional news of our launches, to sign you in, and to let you download the members' library and read new articles early.
- Legal basis: your consent, which you give when you join (Article 6(1)(a) GDPR): the words beside the Join button say what membership is. The membership and the newsletter are one, so withdrawing your consent means leaving, which you can do at any time on the membership page or through the link in every email.
- How long: while you are a member, however long that is. When you leave, on the membership page or through the link in an email, the emails stop at once and we keep your record, with when you left, so that we can show you asked us to stop. We delete it six years after you leave, or sooner if you ask, keeping only a one-way hash of your email address so that we never email you again. Records of sign-ins and downloads are kept for no longer than 24 months.
When you subscribe to the newsletter
- What: your email address, your name if you gave it, and when and how you subscribed. If you also have a profile with us, we keep its details: when it was created, any account or member areas, the lists and topics you chose, a summary of your purchases, donations and bookings, and your country.
- Why: to send you The Innovation Mode Newsletter, about one email a month, and to understand which topics our readers follow.
- Legal basis: your consent, which you gave when you subscribed (Article 6(1)(a) GDPR). You can withdraw it at any time through the link in every email.
- How long: while you are subscribed, however long that is. When you unsubscribe, the emails stop at once and we keep your record, with when you unsubscribed, so that we can show you asked us to stop. We delete it six years after you unsubscribe, or sooner if you ask, keeping only a one-way hash of your email address so that we never email you again.
If you have a profile with us but do not subscribe
- What: your email address, your name if you gave it, and the details of your profile: when it was created, any account or member areas, a summary of your purchases, donations and bookings, and your country.
- Why: to recognise you if you buy from us again or get in touch. We never send you the newsletter or any other marketing unless you subscribe.
- Legal basis: our legitimate interests in knowing who our customers and contacts are (Article 6(1)(f) GDPR) and, for purchases, our legal obligations (Article 6(1)(c) GDPR).
- How long: six years from your last purchase or contact with us; for purchases, that is the period Irish tax law requires. We review these profiles every year, and if you ask, we delete yours sooner, where the law allows.
When you buy a product
You buy on our checkout page, where the payment form is provided by our payment provider, Stripe.
- What: your email address, the name and billing details you give at checkout, the organisation named on a toolkit licence, the products you buy, the price, VAT details, the payment status, and your agreement to immediate download. Stripe processes the payment; we never see or store your card details.
- Why: to process your order, deliver your download, answer licensing and support questions, and keep the accounting and tax records the law requires.
- Legal basis: performance of our contract with you (Article 6(1)(b) GDPR) and our legal obligations (Article 6(1)(c) GDPR).
- How long: six years from the end of the financial year of the purchase, as Irish tax law requires.
Stripe also uses details of the payment and of your device to detect and prevent fraud, under its own privacy policy.
When you apply for a role
- What: the information in your email, CV and portfolio.
- Why: to assess your application and contact you about it.
- Legal basis: steps you ask us to take before entering into a contract (Article 6(1)(b) GDPR).
- How long: up to 12 months after the role is filled, unless you agree that we keep your details for future roles.
We do not use personal data for automated decision-making or profiling. Please do not send us sensitive information, such as health data, through the forms: we do not need it.
6. International transfers
We keep personal data in the European Union where we can, and the website is hosted in the EU. Some of our providers, or their support teams, are in other countries, including the United States.
Where personal data leaves the European Economic Area, we rely on an adequacy decision of the European Commission (such as the EU-US Data Privacy Framework, for certified companies) or on the Commission's Standard Contractual Clauses, with additional safeguards where needed.
7. Your rights
You have the following rights over your personal data, and exercising them is free of charge:
- Access: ask for a copy of the personal data we hold about you.
- Rectification: ask us to correct inaccurate or incomplete data.
- Erasure: ask us to delete your data, where we have no legal reason to keep it.
- Restriction: ask us to limit how we use your data while a concern is resolved.
- Portability: receive the data you gave us in a structured, machine-readable format.
- Objection: object to processing based on our legitimate interests. You can always object to direct marketing, and we will stop.
- Withdrawal of consent: where we rely on your consent, withdraw it at any time, without affecting what we did before.
You can see your membership, and leave it, which stops every email, at any time on the membership page.
To exercise a right, email info@theinnovationmode.com. We reply within one month; if a request is complex, we may extend this by up to two further months and will tell you why. We may ask you to confirm your identity first.
If you are unhappy with how we handle your data, please tell us first so that we can put it right. You also have the right to complain to the Data Protection Commission (dataprotection.ie) or to the supervisory authority where you live or work.
We apply the same standards to every visitor, wherever they live. We do not sell or share personal information as those terms are used in California privacy law.
8. Security
The website is served only over encrypted connections (HTTPS). We collect only the personal data we need, and access to it is limited to the people who need it for their work.
No system is perfectly secure, so please do not send confidential business information through the forms. When it is needed, we will agree a secure way to exchange it.
9. Children
The website is for professionals, students and educators. It is not directed at children under 16, and we do not knowingly collect their personal data. If you believe a child has sent us personal data, contact us and we will delete it.
10. Changes to this policy
We review this policy when the website or our providers change, and the date at the top shows the current version. If a change materially affects how we use data you have already given us, we will tell you by email where we can.
